There are significant questions surrounding the organizational attorney-client privilege and the attorney’s duty of confidentiality to his or her organizational client under Rule 1.6 of the Colorado Rules of Professional Conduct (“Colo. RPC”) and Colorado statutes.  These are important questions and impact the practice of law for all lawyers dealing with business organizations – whether in transactional engagements or in litigation.  This will include a discussion of Colo. RPC, including Rules 1.13, 1.6, 1.7, 1.8, 1.9, and Formal Opinions 68 and 135, as well as the statutory attorney-client privilege.
