Learning objectives include:

  • House Bill 1090’s codification and enactment January 1, 2026. The change in legislation has implications for lawyer fee agreements (Rule 1.5), advertising (Rule 7.1 and 7.2), and solicitation (Rule 7.3).  It also broadly implicates Rule 8.4 and case law, including Crow v. Tull.
  • Recent CBA Ethics Opinions 148, 136, with a focus on Rule (1.6 confidentiality).  Both opinions raise ongoing concerns about including clients of reply all email chains, responding to client reviews online, and the overriding concern that confidentiality is broader than attorney-client privilege.
  • Recent CBA Ethics Opinion  149 (virtual practice), including discussion of Rule 1.1 (competence) and keeping abreast with technology.
  • Also will discuss CBA Ethics Opinion 150 (crowdfunding) which implicates third-party payor of legal services, conflicts, and confidentiality.
  • Recent ABA Ethics Opinions 5126 (terminating client representation)
  • Recent Supreme Court opinions, namely the People v. Stanley case. 
  • Potential changes to the Colorado Rules of Professional Conduct and Discipline.  Both rule sets have proposed changes that are out of comment period and the upcoming hearing on comments in November 19.

Help Keep Released ACJ Inmates Warm This Winter

The Arapahoe County Bar Association is partnering with the Arapahoe County Jail to collect coats and other winter essentials for individuals being released from the Arapahoe County Jail. Many individuals are arrested during warmer months and released without appropriate clothing for the cold.

We’re asking for donations of used or new coats, hats, gloves, boots, and other winter gear for adult men and women.

Drop-off locations:

· At the Professionalism Dinner — dropoff box

· After the event — donations can be brought to the Arapahoe County Courthouse, blue bin will be in the lobby

Your contribution can make a meaningful difference for someone facing the cold with limited resources. Thank you for your support!
